Thrive by Five Washington Privacy Statement

Welcome. This Privacy and Information Security Policy ("Policy") covers information collected through www.thrivebyfivewa.org. ("Site") and information relating to the subject matter of the Site. When the information personally identifies an individual and is subject to an applicable data protection or privacy law ("PII"), it is subject to the restrictions imposed on us by this Policy; otherwise, we may use the information (including non-PII) for any lawful purpose.

WHO WE ARE

We are Thrive by Five Washington ("we" or "us"), a Washington nonprofit corporation formed by a public-private partnership working to help ensure that all Washington children succeed in school and life, and if you have questions or concerns you may e-mail us at info@thrivebyfivewa.org.Your PRIVACY is important to us. We NEVER trade, sell or rent the contact information of our subscribers. Your home address is used to determine your elected officials by your district and to keep our internal records up-to-date. We only gather personal information from you via the Internet if you provide it voluntarily. Thrive by Five Washington is committed to protecting your privacy.  The policies below are applicable to the Thrive by Five Washington website.  In general, we only gather personal information from you via the Internet if you provide it voluntarily. 

PERSONAL INFORMATION WE COLLECT

In offering and providing this website to you, we collect certain information relating to your use of the website, including information that identifies you, such as your name, address or credit card, as well as other information that you provide to us ("personal information").  In addition, personal information includes information that we collect from our interactions with you, for example, when you send us e-mail.  You do not have to provide any personal information unless you choose to do so. 

You are in control of the personal information that you provide to us. You agree not to provide PII or confidential or sensitive information unless: (1) you have obtained any required permission to do so under applicable law and, (2) for PII, have informed the person whose data will be included that their PII will be subject to this Policy and you have obtained their consent to this Policy. By providing information to us, you represent and warrant that you have made all required disclosures and obtained all required permissions.

You do not have to provide any personal information.  Your home address will only be used to identify your elected officials by legislative district, to validate you as an official constituent, and to keep our internal records up-to-date. Your name and other information will be placed on our mailing list unless you choose to opt-out of receiving hard copy mailings. We will provide options to opt-out from these mailings at multiple locations on our website.  We do not sell any customer lists or e-mail addresses.  Although, the Thrive by Five Washington is a partner in the Washington Children's Web Communication Hub, personal information you provide is only available to partner organization(s) to which you have subscribed. 

INFORMATION EXCHANGE BETWEEN YOUR COMPUTER AND OUR WEBSITE

We routinely learn certain information about visitors to the Site such as:

  • the domain name and host from which you access the Internet and the Internet address of the Site from which you direct-linked to ours;
  • the date and time you access the Site and pages you visit;
  • your computer's IP address and information about its operating system, and the Web browser you use. Thrive by Five Washington anonymously tracks your visit in order to compile statistical information about the use of our website. We do not collect individual information about you or your use of this site through your IP address;
  • information to combat fraud or misuse;

Cookies and E-Mail Addresses

  • Cookies are pieces of information that are stored on your computer to help identify you while you visit our website.  We use cookies to make visiting and using our website easier -- so that you don't have to continually re-enter form information and so that we can tailor your visit to your expressed preferences.  We do not use cookies to surreptitiously collect any personal information from your computer.  Your browser can be set to reject cookies if you desire, but this may make some of our website difficult or inefficient to access.
  • Our website does not automatically recognize your e-mail address. We collect the e-mail addresses of those who communicate with us by mail or and on some of our web pages.  We use e-mail links to allow you to contact us directly with questions.

Public Areas

Please remember that any information you share in public areas, such as message boards or feedback sections, becomes public, and therefore this privacy policy does not apply to any information you choose to make public.  Please be careful about what you disclose and do not post any personal information that you expect to keep private.

OUR USES OF INFORMATION

What We Will Not Do: Generally, we will not sell or rent PII to a non-affiliated third party for their for-profit marketing purposes, absent your consent to do that. We reserve the right to share PII with charitable or non-profit organizations for their promotional purposes, however.

What We May Do: In general, we use PII to process, respond to, communicate about, investigate and enforce our rights and materials you may submit. We tend to use non-PII for purposes such as measuring the number of visitors to sections of our Site, making our Site more useful to visitors, and other purposes.

Subject to applicable law, we reserve the right to do the above and the following worldwide: use, access (or bar access to), process, disclose, display, share, transfer, store, sell, retain, commingle, investigate, verify, prove and otherwise deal, voluntarily or as required by law, with (collectively "Disclose") all PII, non-PII and other information. We may Disclose the foregoing internally or to third parties or through any databases for any purpose not prohibited by law or, in our discretion, to help prevent or address perceived harm, damage or loss to us or others. Without limiting the foregoing we provide the following examples of what we may do. We may Disclose information, including PII:

  1. to respond to your requests and to respond (as legally required or voluntarily) to requests from or reports to governmental or similar authorities, other charitable organizations, credit reporting agencies and others who deal with or inquire about you;
  2. to and from any locations worldwide, such as locations of us or our agents, affiliates, service providers. This includes (but is not limited to) transfers in acquisitions, mergers, sales of assets, restructuring, changes of control or operations or the like;
  3. to enforce, actual or potential transactions, requests, actions, applications, proposals, grants and rights;
  4. to enable performance by, or meet requirements of, third parties such as service providers, content providers, affiliates, agents, investigators, attorneys, researchers, consultants, auditors, lenders, publicists and others;
  5. to respond to legal process or to make Disclosures under programs intended to prevent or investigate persons or potential crimes. This includes but is not limited to checking any or all PII with the U.S. Treasury"s Office of Foreign Assets Control. We reserve the right (but do not undertake an obligation) to notify you of legal process such as a subpoena or the like, if notification is lawful. If there is objection to our responding, the objecting person must seek a valid court order (from a court in the correct jurisdiction) allowing us to delay or forego responding and serve it on us at least 3 business days before we must respond;
  6. to promote our mission or other charitable purposes
  7. to occasionally have third party agents, subsidiaries, affiliates and joint ventures perform functions on our behalf, such as credit card processing, shipping or stocking orders, providing customer service, etc.  These entities have access to personal information of yours needed to perform their functions, and are contractually obligated to maintain the confidentiality and security of that personal information.  They are restricted from using or altering this data in any way other than to provide the requested services to the Site.
  8. to create and share reports containing anonymous, aggregate data about our users or otherwise use or share aggregate data about our users.  This data will not contain any of your personal information.

The above descriptions are not a list of all possible Disclosures we may make. This Policy is intended to aid your understanding of our general practices.

We generally will retain information for as long as required, allowed or we believe it useful, but do not undertake retention obligations. We may dispose of information in our discretion without notice, subject to applicable law. You must keep your own, separate records.

CHOICE

This Policy reflects what we believe is needed to effect our charitable mission. If you are not comfortable with the Disclosures we may make, please do not provide any information to us or otherwise use the Site.

We generally do not send "commercial e-mails" (e.g., e-mails whose primary purpose is to advertise a product or service); if we do, we will provide any "opt-out" choice required by applicable law. We reserve the right to communicate with you about any subject matter of the Terms or any other subject matter not prohibited by law.This site gives you the opportunity to opt-out of receiving additional information from the Thrive by Five Washington and to correct or update any personal information that we may have. You should be aware that when you are on our website you could be directed to other websites that are beyond our control.  There are links on our website that take you to other websites outside our service.  These links include links from sponsors and partners.  These other sites may send their own cookies to you, collect data or solicit personal information.  Please note that this privacy policy applies only to this website and not to other companies' or organizations' websites to which we link.  We have clearly marked our website with our logo so you know where this privacy policy applies.

SENDER OF MESSAGES

As a member of thrive by Five Washington Online, you may occasionally receive messages of broad interest on issues related to children and families from one of our partner organizations in the Washington Children's Web Communications Hub.   If you desire to receive messages only from individual organizations you specify, go to http://www.childrenshub.org/ec2/smp.html and select them on your Subscription Management page.

CREDIT CARD SECURITY

Thrive by Five Washington appreciates donations we receive which help us to continue our work.  It is important to us that any information you provide when making an online donation remains secure.  Your credit card information is secured by a reputable security company.  The information is used only for that particular transaction and is not stored.

SECURITY AND CONSENT

The importance of security for all personal information associated with you is of utmost concern to us. We exercise great care in providing secure transmission of your information from your PC to our servers. Personal information collected by our website is stored in a secure area that is not available to the public.  In many instances, such as in the case of credit card numbers, your personal information is encrypted before you conduct your transaction.  Only those employees who need access to your information in order to do their jobs are allowed access.  While we make reasonable efforts to safeguard your personal information once we receive it, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.  As a result, we cannot ensure or warrant the security of any information you transmit to us or information we transmit to you from our website, and you do so at your own risk.

Please note:

  • Your e-mails to us are not necessarily secure against interception so do not include sensitive information in them—we generally will not ask for passwords or the like in an email and you should assume that if you get such a request, it might be fraudulent.

  • We believe that the security we have in place is appropriate to the subject matter of our Site, but WE DO NOT GUARANTEE SECURITY. If applicable law imposes any non-disclaimable duty (if any), you agree that the standard used to measure our compliance with that duty will be one of intentional misconduct.
  • Your Consent to Email Notice: If we are required to disclose or provide notice of invasion of certain security systems, we will do so when required by posting notice on our Site or, in our discretion, by giving it to any email address provided by you.
